Defense Doctor Ruins C Man Hit in Rear Receives $1.6M for Spinal Injury
to a driver for injuries he sustained after being struck from behind in 2009.Walter J. Nary was waiting at a stoplight when he was hit and suffered permanent acute lumbar spine injuries. The Monroe County Supreme Court jury handed $1.25 million to Mr. Nary for past, present, and future pain and suffering as well as loss of enjoyment of life. He also received $321,250 for past and future medical costs. The total bill came out to $1,571,250.The defendant (unnamed in the article) was insured by State Farm Mutual Automobile Insurance Co. They originally offered only $5,000 in damages. This made the decision to go to trial simple. One of the factors leading to the jury's decision was that the defendant's medical expert, Dr. Robert Lifeso, was found not to be credible. It was revealed that he has had a long relationship with State Farm, as well as the defendant's lawyers, Hagelin & Kent. Dr. Lifeso has received more than $10 million in independent medical examination fees over the past ten years. State Farm alone has paid him at least $2 million within that time.As a practicing medical malpractice, wrongful death, and personal injury attorney in New York, I deal with terrible& accidents like this every day. Office Hours: By Appointment Onlydidn’t come into this week short on things worth worrying about, but at least they had .
2014 American League MVP runner-up was just fine, thank you.
key word there is “was.” And for
Tigers, that has
potential to be devastating.
Tigers announced on Thursday, Martinez has a left knee injury that’s going to require him to go under
Not mentioned is how long Martinez’s recovery is going to take, but these tweets from Bob Nightengale of&USA Today&and Jon Morosi of Fox Sports cast doubt on
possibility of him being ready for Opening Day:
In other words: No, this is not a minor thing.&If
switch-hitting 36-year-old repeating his league-leading .974 OPS and career-high 32 home runs from last season weren’t already long enough, Martinez now has to worry about making a full recovery and getting on track without
benefit of spring training.
Tigers can hope for
best, but they need to plan for
worst.&And in this case,
worst could be pretty bad.
Earlier this week, Tigers general manager Dave Dombrowski said, via ,&that his roster for 2015 is “basically set.” Since that pretty much goes for
league’s other 29 rosters, now’s a safe time to look at what each team has and project how they could perform in 2015.
And for that, we have actual projections.
good news is that
Tigers pegged as
top team in
AL Central.
bad news is that it’s not by much. Both systems&barely place them ahead of
&and not that far ahead of
other teams in
division. And overall, Detroit’s&projected record is
worst among baseball’s projected division champs.
This sounds silly based on
Tigers’ recent history as
dominant team in
AL Central, but anyone with objectivity&will know
projections have a gripe.&As we said at
Tigers came into
week with plenty of things worth worrying about.
Max Scherzer and Rick Porcello are gone and have been replaced by Alfredo Simon and Shane Greene. Justin Verlander is coming off a year that screamed “Decline!” Miguel Cabrera appears to be . J.D Martinez is a huge regression candidate. And as per usual,
Tigers bullpen stinks.
middle of all this were two pieces that looked solid. One was David Price, and
other was Martinez. And even with
latter unlikely to repeat his other-worldly 2014, both BP’s and FanGraphs‘ projections were taking it for granted that he would be one of Detroit’s more productive hitters in 2015.
And in fairness, there is a chance he will be. Maybe he can make a quick and strong recovery, step into
box on Opening Day and go from there.
We have good reasons, however, not to take that possibility for granted.
For starters, there’s
reality that Martinez is a 36-year-old former catcher. It’s not advised to expect quick and strong recoveries from players like that. Throw in how Martinez missed
entire 2012 season with a left knee injury, and a quick and strong recovery seems all
more unlikely.
This is not to say he can’t be ready by Opening Day or shortly thereafter, mind you. Really,
bigger question is
one that Jon Morosi posed:
To this end, there isn’t a whole lot of precedent we can turn to. But one particularly scary example is Joey Votto.
In 2012, Votto was on an absolutely roll with a .342 average and a .604 slugging percentage through 86 games. But then he
on his own left knee, and he returned to hit just .316 with a .421 slugging percentage. That’s a huge loss of power, one that Votto hasn’t yet fully recovered from.
There’s one example of a hitter brought low by
kind of injury Martinez is dealing with, and he himself doesn’t have
most encouraging history with recovering from serious knee injuries.
When Martinez came back from his year off in 2013, he never really got his power going. As
can show, even as he increased his batting average by over 100 points from
first half to
second half, his Isolated Slugging (slugging percentage minus singles) only improved by 17 points.
As .com’s Anthony Castrovince put it, Martinez’s power was compromised because he was still working to “get his legs back into playing shape.” And throughout
year, it’s not surprising that his power was&slightly worse from
left side of
plate. When batting lefty, his surgically repaired left leg wasn’t exactly a sturdy foundation from which to draw power.
Granted, Martinez’s latest knee injury isn’t as serious as
torn ACL that robbed him of his 2012 season. But there could very well end up being a sizable gap between
time when Martinez is healthy and
time when he’s in real playing shape. Those two are different things, after all.
price for that is a notable loss of power, a guy who was
Tigers’ most dangerous hitter in 2014 is going to be rendered ordinary for a solid chunk of 2015. In light of
lack of talent separation between them and
AL Central, that could be a deal-breaker for their entire season.
What could brighten
mood would be Dombrowski pulling a rabbit out of his hat like when he responded to Martinez’s 2012 injury by signing Prince Fielder. That ended up having
desired effect, as Fielder easily replaced Martinez’s production.
But don’t count on this happening. There are no hitters even close to Fielder’s caliber on
free-agent market, and
Tigers are short on
payroll flexibility and
expendable assets they would need to acquire a star-level hitter in a trade.
Tigers should be doing right now is wishing, hoping and/or praying that Martinez can shrug this injury off and immediately start hitting like it never happened.
Because right now, it looks like a season that hasn’t even begun yet has been dealt a killing blow.

Barred from the ring: 14-year-old Thomas White may never fight again. Picture: COLIN GARVIE
A boy's career as a boxer is in jeopardy after he was blasted in the eye with a dangerous homemade catapult.
Doctors have barred Thomas White from the ring fearing a blow to the head could leave him with permanent damage to his left eye.

The promising 14-year-old, who has been Scottish champion for his age and weight for the past two years, has already been forced to pull out of representing Scotland in an international match against Wales.
Now Thomas, of Halfway near Cambuslang, is worried he may have to hang up his gloves for good after the incident involving a so-called ''Johnny Poppers'' homemade catapult.
He said yesterday: ''I'm devastated by what's happened. I want to be a professional boxer when I'm 16 and I've been training really hard for it but now my career could be finished.''
Earlier this year, eye doctor Kerr McAndie warned of the
dangers posed by the homemade slingshots which have seen an upsurge in popularity among youngsters this year.
They are made from condoms or rubber glove fingers and the neck and mouth of plastic bottles and used by children to fire peas or stones.
Dr McAndie, of the Southern General Hospital in Glasgow, said last night: ''This is exactly the sort of accident I was talking about.
''These catapults are the nineties street version of the peashooter but they are also potentially lethal weapons.''
One of Thomas's trainers at O'Neills Amateur Boxing Club, Mr Brian Murphy, said: ''This injury could ruin his career and in my opinion Thomas is one of the best for his age in Scotland if not in the whole of Britain.
''He's very dedicated and could turn professional if he gets over this setback.
''On doctors orders he can't fight just now because he could risk losing his eyesight but hopefully he will go back into the ring eventually.''
Thomas was hit by a frozen pea fired from a Johnny Poppers as a group of youths larked about on the streets near his home.
He said: ''I had gone out to play for a bit before I went to the gym to train when I saw a big white flash and fell to the ground in pain. That's when I realised I had been hit in the eye with a pea.
''My left eye was really sore and stinging so I went home and my mum got packets of frozen peas to get the swelling down.
''But the pain wouldn't go away and I kept being sick so she took me to hospital.''
Thomas was taken to Hairmyres Hospital in East Kilbride before being referred to eye specialists at Stonehouse Hospital in Strathaven.
He was kept in overnight where surgeons discovered blood and fluid building up and raising the pressure in the back of his eye.
Thomas said: ''The doctor advised me not to box until the new year at the earliest and even then I may still not be able to go back although I'm hoping I can.
''Either way it's going to set back my career because I can't even train. I was supposed to get some new boxing gear at Christmas but I don't want it now because I may never be able to use it.''
His father, also Thomas, 41, said: ''We're very proud of Thomas and he's been told he could make a professional career out of boxing. He trains really hard and is really upset by this setback.''
Mother Elizabeth, 37, added: ''What happened was an accident but I'm very annoyed about it. These peashooters are extremely dangerous and the kids don't realise just how powerful they are and the damage they can cause.
''We're just lucky that Thomas hasn't lost his sight because of it.''
Chief Inspector Alex McSorley, of Rutherglen Police, warned that youngsters could face criminal charges if they are caught with Johnny Poppers.
He said: ''It's not desirable to have them and they could find themselves being the subject of a report to the procurator-fiscal.
''These homemade weapons are extremely dangerous and go off like an Exocet missile.''
