Do cops need a warrant to do the old fashioned stake out to track you?If not, how is using your cell phone to track you any different?I understand that monitoring calls/texts is different, but how is just using it to follow you any different than doing so in a car?

It's different because the police could track everybody all the time with that technology, whereas before that would be an impossibility. &So it raises the possibility of being tracked by the police indefinitely because you jaywalked, or gave a cop the finger.Prior to the advent of just about everybody carrying around a personal locator beacon on them, if the police wanted to follow you they had to assign officers to do it. &That meant that they couldn't follow everybody, it was limited generally to the worst offenders, and in fact the police had limits on what they could do: &They couldn't follow the person on to private property, for example, without some sort of exigent circumstances, or a warrant. &Also, as practical matter, if the person noticed the police were following them, they could just simply go home or try to lose them.With cell phone tracking, the police can "follow" that person on to private property, and they can follow them no matter what the person does, so long as they don't turn the phone off. &From a technical standpoint, they can do it forever with pretty much zero manpower.Making them justify the need for such to judge seems like a relatively small hurtle.

Haha! You Murricans are so funny.We've had some murderers and rapists convicted (partly) through their cell phone records here in Australia. And we've probably had some people cleared by the same method.Now if you were innocent of a crime, wouldn't you want these records entered into the court record? It's only if you were guilty that you wouldn't. Or if they might make it seem like you were guilty, I guess, in which case they really do need more evidence. If they convict you on cell phone records alone, that's pretty farkin' lazy, and I doubt our courts could get away with it. Your courts are almost certainly different in that regard, from what we've been seeing.
Why are people still shocked about these rulings? Are people such parrots they haven't noticed yet which justices keep defending the 4th.
