　　8月10日，CFDA官网发布《关于药包材药用辅料与药品关联审评审批有关事项的公告》（2016年第134号），就有关事项公告如下：
　　一、在中华人民共和国境内研制、生产、进口和使用的药包材、药用辅料，适用本公告要求。进口药品中所用的药包材、药用辅料按照《药品注册管理办法》的相关规定执行。
　　二、国家食品药品监督管理总局按照风险管理的原则在审批药品注册申请时对药包材、药用辅料实行关联审评审批。国家食品药品监督管理总局制定公布实行关联审评审批的药包材、药用辅料范围，并根据工作需要进行调整和完善。暂未列入关联审评审批范围的药包材、药用辅料应符合药用要求。

　　2.鼓励按照包装系统进行申请，如果因为一些技术原因不能按照完整的包装系统进行申请，也可以按照包装组件进行申请。
第二部分 &药用辅料
　　一、境内外上市制剂中未使用过的药用辅料；　　
　　二、境外上市制剂中已使用而在境内上市制剂中未使用过的药用辅料；　
　　三、境内上市制剂中已使用，未获得批准证明文件或核准编号的药用辅料；　　
　　四、已获得批准证明文件或核准编号的药用辅料改变给药途径或提高使用限量；　　
　　五、国家食品药品监督管理总局规定的其他药用辅料。
　　注：1.高风险药用辅料一般包括：动物源或人源的药用辅料；用于吸入制剂、注射剂、眼用制剂的药用辅料；国家食品药品监督管理总局根据监测数据特别要求监管的药用辅料。境内外上市制剂中未使用过的药用辅料按照高风险药用辅料进行管理。
　　2.已在批准上市的药品中长期使用，且用于局部经皮或口服途径风险较低的辅料，如矫味剂、甜味剂、香精、色素等执行相应行业标准，不纳入本目录。
　　三、自本公告发布之日起，药包材、药用辅料应按程序（见附件）与药品注册申请关联申报和审评审批，《药包材及药用辅料申报资料要求》另行公布。各级食品药品监督管理部门不再单独受理药包材、药用辅料注册申请，不再单独核发相关注册批准证明文件。
　　四、药包材、药用辅料发生改变处方、工艺、质量标准等影响产品质量的变更时，其生产企业应主动开展相应的评估，及时通知药品生产企业，并按要求向食品药品监督管理部门报送相关资料。药包材、药用辅料变更的相关要求由国家食品药品监督管理总局另行制定。
　　五、已批准的药包材、药用辅料，其批准证明文件在效期内继续有效。有效期届满后，可继续在原药品中使用。如用于其他药品的药物临床试验或生产申请时，应按本公告要求报送相关资料。
　　批准证明文件在日（含当日）前到期的药包材、药用辅料，有效期延续至日。自日起，用于其他药品的药物临床试验或生产申请时，应按本公告要求报送相关资料。
　　在已上市药品中历史沿用的其他符合药用要求的药用辅料，可继续在原药品中沿用。但用于其他药品的药物临床试验申请或生产申请时，应按本公告要求报送相关资料。
　　六、药包材、药用辅料生产企业应对产品质量负责；应在满足相应生产质量管理要求的条件下组织生产；应配合药品生产企业开展供应商审计。
　　七、药品注册申请人应确保所使用药包材、药用辅料符合药用要求；应加强药包材、药用辅料供应商审计；应及时掌握药包材、药用辅料的变更情况，并对变更带来的影响进行研究和评估，按照《药品注册管理办法》等有关规定向食品药品监督管理部门提交相应的补充申请。
　　八、药包材、药用辅料生产企业所在地的食品药品监督管理部门应将行政区域内药包材、药用辅料生产企业纳入日常监管范围。国家食品药品监督管理总局根据需要对进口药包材、药用辅料生产企业进行监督检查。
　　九、本公告自发布之日起施行。此前已受理的药品、药包材和药用辅料注册申请继续按原规定审评审批，此前药品、药包材和药用辅料审评审批要求与本公告不一致的，以本公告为准。
药包材、药用辅料与药品关联审评审批程序
　　一、药包材、药用辅料应与药物临床试验或生产申请关联申报，药包材、药用辅料生产企业应填写《药包材申报表》或《药用辅料申报表》，注明所关联的药品注册申请的申请人、药品名称和受理号，向所在地省级食品药品监督管理部门如实提交申报资料，进口药包材、药用辅料生产企业向国家食品药品监督管理总局行政事项受理服务和投诉举报中心（以下简称食品药品监管总局受理和举报中心）提交申报资料。
　　药品注册申请人在提交药品注册申请时，在药品注册申请表中&药包材来源&和&原辅料来源&项目中应注明全部关联的药包材和药用辅料的相关信息。
　　二、省级食品药品监督管理部门或食品药品监管总局受理和举报中心应按照《药包材及药用辅料申报资料要求》，对申报资料项目和相关证明性文件进行形式审查，符合要求的予以受理并核发《受理通知书》，按规定需要检验的，同时核发《检验通知书》。
　　已受理的药包材、药用辅料，用于其他药品的药物临床试验或生产申请时，可提供该药包材、药用辅料《受理通知书》，无需重复提交相关资料。
　　三、对本公告中规定的国产高风险药包材、药用辅料，其生产企业在关联申报时，应提交《药包材及药用辅料研制情况申报表》；省级食品药品监督管理部门应在受理后30日内完成现场核查，抽取连续生产的3批样品送省级检验机构检验，并将申报资料、《受理通知书》《检验通知书》和《药包材及药用辅料现场核查报告表》等相关资料报送国家食品药品监督管理总局药品审评中心（以下简称食品药品监管总局药审中心）。检验机构应在接到检验通知和样品后60日内完成检验，将检验报告书报送食品药品监管总局药审中心。
　　对本公告中规定的进口高风险药包材、药用辅料，食品药品监管总局受理和举报中心受理后，通知中国食品药品检定研究院组织对3批样品进行注册检验，检验机构应在接到检验通知和样品后60日内完成检验，将检验报告书报送食品药品监管总局药审中心。食品药品监管总局药审中心在技术审评期间可基于风险评估要求开展现场核查。
　　对非高风险的药包材、药用辅料，申报单位在申报资料中应提供连续生产的3批产品的检验报告书。食品药品监管总局药审中心在技术审评期间可基于风险评估要求开展现场核查。
　　四、省级食品药品监督管理部门报送食品药品监管总局药审中心的药品注册申报资料中药包材、药用辅料的证明性文件应包括以下内容之一：
　　（一）有效的药包材、药用辅料注册证；
　　（二）按本公告要求完成关联审评后获得的药包材、药用辅料核准编号；
　　（三）按本公告要求实行关联申报的药包材、药用辅料《受理通知书》。
　　五、食品药品监管总局药审中心对药品注册申请及其关联申报的药包材、药用辅料的申报资料进行汇总，并按照《药品注册管理办法》等相关规定开展技术审评，必要时可以要求药品注册申请人和药包材、药用辅料生产企业补充资料，补充资料时限按《药品注册管理办法》规定执行。
　　六、药品生产申请获得批准后，食品药品监管总局药审中心将该药品所关联申报的药包材、药用辅料信息纳入数据库，给予核准编号，告知申请人并主动公开必要的信息。药品生产申请不予批准的，向该药品所关联申报的药包材、药用辅料企业出具《审批意见通知件》，并说明理由。
　　七、药品注册申请人依据《药品注册管理办法》提出&变更处方中已有药用要求的辅料&的补充申请时，变更后的药用辅料尚未取得批准证明文件或核准编号的，可按照本公告要求与该补充申请进行关联申报。
　　仿制药质量和疗效一致性评价中需要变更药用辅料种类或供应商的，变更后的药用辅料尚未取得批准证明文件或核准编号的，可参照本公告要求，与仿制药质量和疗效一致性评价相关申请关联申报。
